Torvalds认为微软应该公布它所宣称的侵犯专利的名称，以便让这个声明接受法庭检验或是让开源开发者重写相关代码。微软不会真的去起诉哪一个人，因为Linux使用者很有可能也是微软的客户。相比起诉，微软更乐意使用FUD（恐惧、不确定、怀疑）心理恐怖战术。

Linux内核开发团队的领导人Linus Torvalds犀利地回应了Microsfot高层管理人员在财富杂志的某篇文章上所声称的Linux和其他开源软件侵犯了自已235项专利的声明.
“毫无疑问，MicroSoft所侵犯的专利比Linux多得多“Linux内核开发团队的领导人Linus Torvalds表示，如果MicroSoft敢将Windows的源代码拿出来接受像Linux一样的审查，很容易就可以发现MicroSoft侵犯了多少其他公司所拥有的专利.
“关于操作系统的理论研究在1960年就已经相当完善了.IBM在这其中可能真正拥有上千条的基础性专利”Torvalds在回答InformationWeek所提出的问题时表示，他不会受到任何形式的专利约束.”基础理论研究在半个世纪以前就已经完成了，而且这些理论历时已久基本已经超出专利保护的期限”.
Torvalds说道,Microsoft应该将他所声称被侵犯的专利名称列举出来，并交由司法机构查证.以便于开源软件的开发人员对相关代码进行重写，以避免对其专利的侵犯.
“如果MicroSoft列举出来，很有可能的出现的结果就是其所谓的‘专利被侵犯’根本就不存在“Torvalds说:”或者我们可以很轻易地就绕开他们那些可笑的专利”.

"It's certainly a lot more likely that Microsoft violates patents than Linux does," said Torvalds, holder of the Linux trademark. If the source code for Windows could be subjected to the same critical review that Linux has been, Microsoft would find itself in violation of patents held by other companies, said Torvalds. 代码： 全选
"Basic operating system theory was pretty much done by the end of the 1960s. IBM probably owned thousands of really 'fundamental' patents," Torvalds said in a response to questions submitted by InformationWeek. But he doesn't like any form of patent saber rattling.
